PUBLIC NOTICE OF APPLICATION
FOR COASTAL WETLANDS PERMIT
AND WATER QUALITY CERTIFICATION

Cavenham Forest Industries, LLC has filed an application requesting permission to conduct regulated activities under the provision of the Coastal Wetlands Protection Law Act, Title 49, Chapter 27, Mississippi Code of 1972.

The applicant is proposing activities associated with a United States Environmental Protection Agency (EPA) mandated remediation of a closed creosote plant located adjacent to Turkey Creek at 9502 Creosote Road in Gulfport, Harrison County, MS.  Activities associated with the project include the construction of a sheetpile bulkhead approximately 250 feet in length at the current mean high tide (MHT line) and waterward of jurisdictional wetlands for shoreline stabilization and erosion control. No backfill is associated with the proposed bulkhead. A temporary work pad will be constructed landward of the proposed bulkhead to accommodate construction equipment with all matting and equipment to be removed upon completion of the project.  The proposed project entails the mechanical removal of approximately 1,000 cubic yards of bottom sediments from an area of Turkey Creek measuring 290 feet in length and 40 feet in width.  Removed material will be screened for debris, slurried, and pumped via an above-ground pipe to a lined containment and dewatering area located in on-site uplands.  During sediment removal operations, water quality will be monitored outside of containment structures (turbidity screens, silt curtains, etc.) to ensure no degradation of water quality occurs.  Approximately 215 cubic yards of riprap (6-inch layer) will then be placed over the dredged area.  Finally, the removed sediment will be dried, characterized and transported to a proper disposal facility.  

The applicant will be required to request a variance from Chapter 8, Section 2, Part III.O.1 of the Mississippi Coastal Program which states: “Permanent filling of coastal wetlands because of potential adverse and cumulative environmental impacts is discouraged.”

In compliance with Section 401 of the Federal Water Pollution Control Act (33 U.S.C. 1251, 1341), as amended by PL 95-217, the applicant will request certification from the Office of Pollution Control that the above mentioned activity will be in compliance with applicable provisions of Section 301 (33 U.S.C. 1311), Section 302 (33 U.S.C. 1312), Section 303 (U.S.C. 1313), Section 306 (U.S.C. 1316), and Section 307 (U.S.C. 1317) of the Act and appropriate requirements of the State Law.

Any person wishing to make comments or objections to the proposed regulated activity must submit those comments in writing to the Department of Marine Resources at 1141 Bayview Avenue, Biloxi, Mississippi 39530 before 1:00 p.m. on the day June 5, 2017.
